Criminal Defense Attorney in Fairfield, TX
A charge is not a conviction.
Most arrests here start with a traffic stop on I-45 and end with a charge the driver never saw coming: THC gummies from a smoke shop, a vape pen, a pill bottle, a DWI. Jacob spent three and a half years as Freestone County's First Assistant District Attorney prosecuting exactly these cases in exactly these courtrooms. Now he defends them, in Freestone, Leon, Limestone, and Navarro counties.

DRUG ARRESTS · DWI · FELONIES · MISDEMEANORS
What Jacob defends.
Any arrest. Jacob takes criminal cases of every kind, and the ones below are the charges that walk through the door most often. If you were pulled over and arrested, start with a call.
Drug Arrests on I-45
A roadside search turns a speeding stop into a felony. Around here the arrest comes first and the lab result later.
- THC gummies, vape pens and wax (felony weight, even from a smoke shop)
- Marijuana
- Pills: Xanax, ecstasy, Adderall and other prescription drugs
- Cocaine and methamphetamine
- Possession with intent to deliver
- Drug paraphernalia
DWI & BWI
Breath, blood, or refusal: every DWI has a weak point, and the license clock starts the day of the arrest.
- DWI first offense, including .15 and above
- DWI second, and third or more (felony)
- Intoxication assault and intoxication manslaughter
- Drug-related DWI
- Boating while intoxicated on Richland Chambers
- ALR license hearings and occupational licenses
Evading, Weapons & Assault
The charges that get stacked on top of a stop, and the ones that start at home.
- Evading arrest in a motor vehicle (felony)
- Unlawful carrying of a weapon
- Assault and assault family violence
- Terroristic threat
- Criminal trespass and criminal mischief
- Theft
- Indecent assault
Bond, Probation & Records
Getting out, staying out, and cleaning up afterward.
- Jail release and bond (Jacob can post it himself)
- Bond reduction
- Early termination of probation
- Motions to revoke or adjudicate
- Occupational driver's licenses
- Outstanding warrants
Traffic & CDL
Still handled, case by case, especially when a license or a CDL is on the line.
- CDL violations
- Speeding and moving violations
- License suspension issues
- Failure to appear

Plain Answers
Ask before you worry.
The questions people actually ask about criminal defense, answered the way Jacob answers them: plainly.
General information, not legal advice. Contacting the firm does not create an attorney-client relationship. Have a different question? Contact the office or see all practice areas.
Because in Texas the line between legal hemp and illegal THC is 0.3 percent, and the label on the package doesn't decide it: the DPS lab does. Troopers in Freestone County make the felony arrest on the roadside, the lab result comes back later, and the District Attorney doesn't weigh whether you thought it was CBD. Gummies and wax are heavy, so a smoke-shop purchase can weigh out as a second-degree felony. In Dallas or Houston the same bag might end in a class and a fine. Here it ends in a felony arrest, which is exactly why you want a lawyer who has handled these cases from both sides of the courtroom.
Call. Most mornings a justice of the peace comes to the jail to set bond, and Jacob can post that bond himself, usually faster than a bail bond company because he knows the jail, the Sheriff's staff, and the paperwork, and often for less. One call handles the bond and the defense, instead of paying a bondsman and then starting over with a lawyer. Have the person's full name, date of birth, and the charge from their paperwork if you can.
Less than you fear. Misdemeanors are usually filed, and felonies indicted, within two to three months. Once a felony is indicted you appear in person for arraignment, and most cases take a few monthly settings after that. Jacob handles what he can without you, and when he is hired early he can often talk to the District Attorney before the case is even indicted, which is where the best options usually live: a lesser charge, or a pre-trial intervention agreement.
No. The roadside breath test isn't admissible in court. The field sobriety tests that justified the blood warrant are notoriously unreliable. The probable cause behind the warrant can be challenged, and blood alcohol can rise between the stop and the draw, which Jacob can put in front of a jury with an expert. He has prosecuted and tried DWI cases and knows where they break. Meanwhile, you have fifteen days to request a hearing on your driver's license; Jacob handles that, and the occupational license if you end up needing one.
Because Freestone County juries are ranchers, farmers, and church members, and arguments that work in a big city can backfire in front of them. Jacob tried cases to this community as its prosecutor and lives in it now. He knows the District Attorneys, the judges, and the jail, his office is minutes from the courthouse, and you aren't paying someone to drive in from Dallas or Houston.
A misdemeanor is still a criminal charge, and a conviction can affect your job, your license, and your record for years. Before you plead to anything, sit down and understand your options.
It depends on the charge, and you'll know before you commit to anything. The first conversation is confidential, and Jacob explains how the fee works up front. No surprises, no fine print.
